These Terms of Service ("Terms") govern your access to and use of Probate Helper ("Service"), operated by Probate Helper ("we," "us," or "our"). By creating an account, booking a demo, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Not legal advice. Probate Helper is a software platform. We do not provide legal advice, act as your attorney, or establish an attorney-client relationship with families identified as leads. All legal judgments, client communications, and filings remain the responsibility of the licensed attorney using the Service.
The Service is intended for licensed law firms, estate attorneys, and their authorized staff. You represent that you are at least 18 years old, legally authorized to bind your firm to these Terms, and, where required, licensed to practice law in the jurisdictions you serve through the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
The Service is provided on a subscription basis. Fees, billing cycles, and included entitlements (such as territory, lead volume, and included touchpoints) are described at checkout or in your order form. Subscriptions renew automatically unless cancelled before the next renewal date. All fees are non-refundable except as required by law or expressly stated in writing. You authorize us and our payment processor (Stripe) to charge your designated payment method for all applicable fees.
Subject to your compliance with these Terms and timely payment of fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal law firm business purposes during your subscription term.

You retain ownership of data you upload to the Service ("Customer Data"). You grant us a license to host, process, and use Customer Data solely to provide and improve the Service. You are responsible for ensuring that your collection and use of Customer Data complies with applicable laws and your obligations to your own clients.
The Service surfaces probate opportunities from public records and generates draft documents and mailings. Leads and documents are provided as informational starting points. You are solely responsible for verifying the accuracy of any lead, reviewing every document before filing, ensuring compliance with court rules in your jurisdiction, and obtaining any required client consents. We make no guarantee as to the volume, conversion rate, or revenue value of leads.
You agree that your use of the Service will comply with the rules of professional conduct in every jurisdiction where you practice, including (without limitation) rules governing advertising, solicitation, confidentiality, conflicts of interest, unauthorized practice of law, and the supervision of non-lawyer assistants. You are responsible for determining whether and how to use the Service in light of those rules.
The Service, including all software, models, content, branding, and documentation (excluding Customer Data), is owned by Probate Helper and protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you.
The Service may interoperate with third-party services (payment, mail, data providers). Your use of those services is governed by their own terms, and we are not responsible for their performance.
You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your access if you breach these Terms, misuse the Service, or fail to pay fees. Upon termination, your license ends and you must stop using the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, PROBATE HELPER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold Probate Helper harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including rules of professional conduct.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. Material changes will be communicated by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
